Council Delays Fines in Wholesome Petz Dumpster Dispute, Sets December Deadline
Angela Johnson says moving her dumpster would make waste pickup impossible. The city says the current placement is a liability. The council gave her attorney until December 15 to review the permit.
Angela Johnson, owner of Wholesome Petz, told the city council on November 10 that an 8-yard dumpster the city wants moved from the north side of her building to the east alley will not fit there, according to the minutes. Her attorney, Eric Hendricks, asked the council for a one-month delay on fines while he reviews the permit agreement between the city and Richard and Angela Johnson. The council agreed to hold off until the December 15 meeting. 1
The city has been discussing the relocation with Johnson because the dumpster currently sits on city property. Johnson told the council that her waste hauler, LRS, informed her they cannot service the dumpster from Prairie Street if it is moved to the east alley, according to the minutes. City Attorney David McArdle said HR/Finance Director Megan Lopez contacted LRS directly and was told they can access the dumpster without issues. The two accounts have not been reconciled. 1
Johnson cited her ties to the community: a $1,000 contribution to the Marengo Police Department, donations to local school fundraisers, and a monetary donation to the M.O.R.E. Center sufficient to feed 20 families at Thanksgiving. She also noted that the business provides low-cost animal services to help reduce euthanasia. She stated her desire to stay in Marengo and said she does not want to move her business over a dumpster on city property, according to the minutes. City Administrator Derik Morefield clarified that there has been no conversation about wanting to take over the building, and the council confirmed the city has no interest in relocating or removing the business. Mayor Proffitt said the dumpster is a liability: if someone is injured on city property, the city bears responsibility. 1

Five residents spoke during public comment. Robert Lesiak asked the council to work it out with Wholesome Petz. Beth Shelby called the business a great resource for the community. Dinah Binder said she hoped the council would agree to help. John Kudol asked the council to come up with a solution for the business owner. Jon Surber said he felt the city is doing a great job keeping things fair with ordinances and working with residents and business owners. 2
The council gave Hendricks until the December 15, 2025 meeting to complete his review of the permit agreement. No fines will be assessed before then. 1
